AYSocialSports Waiver and Release of Liability
 

In consideration of being allowed to participate in any league, clinic, tournament, event, social activity, or program organized, arranged, or operated by AYSocialSports (“AYSocialSports”), I understand, acknowledge, and agree to the following:
 

1. Assumption of Risk

I understand that participation in beach volleyball, sports clinics, recreational activities, and related social events involves inherent risks, including but not limited to:

• Falls, slips, trips, and collisions

• Physical contact with participants, equipment, or surroundings

• Sprains, strains, fractures, dehydration, heat exhaustion, and other injuries

• Risks associated with sand, uneven playing surfaces, beach conditions, weather, wind, sun exposure, pedestrian traffic, and outdoor environments

• Risks arising from the actions or negligence of participants, referees, volunteers, organizers, spectators, or third parties

I acknowledge that participation may result in serious bodily injury, permanent disability, illness, property damage, or death.

I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with participation in any AYSocialSports activity.
 

2. Health & Fitness Certification

I certify that I am physically fit and able to participate in volleyball activities and have not been advised otherwise by a medical professional.

I agree that if I am injured, sick, feeling unwell, or otherwise unable to safely participate, I will not participate.

I understand it is my responsibility to know my physical limits and participate accordingly.
 

3. Participant Responsibilities

I agree to:

• Follow all league rules, organizer instructions, and safety requirements

• Inspect facilities, courts, and equipment before participating

• Notify organizers if unsafe conditions exist

• Respect referees, organizers, volunteers, participants, and spectators

• Participate in a safe and sportsmanlike manner

I understand that failure to comply with rules may result in warnings, ejection, suspension, or removal from the league without refund.
 

4. Beach / Outdoor Conditions

I understand that AYSocialSports events may take place on public beach courts, parks, or outdoor recreational areas.

I acknowledge that weather, wind, sand conditions, public activity, and changing environmental factors are beyond the control of AYSocialSports and may impact gameplay or safety.

AYSocialSports reserves the right to modify schedules, locations, or formats due to unsafe or changing conditions.

5. Release of Liability

I, on behalf of myself, my heirs, beneficiaries, executors, administrators, representatives, and assigns, hereby release, waive, discharge, and agree not to sue AYSocialSports, including its organizers, owners, volunteers, referees, contractors, staff, sponsors, partners, venue owners, and affiliates (collectively, the “Released Parties”), from any and all claims, liabilities, damages, injuries, expenses, losses, or causes of action arising from or related to my participation in any AYSocialSports activity.

This release includes claims arising from negligence to the fullest extent permitted under California law.

6. Medical Authorization

In the event of an injury, accident, or medical emergency, I authorize AYSocialSports staff, organizers, volunteers, or emergency responders to obtain medical treatment deemed necessary.

I understand that I am solely responsible for any medical costs incurred.

7. Photo & Video Release

I grant AYSocialSports permission to photograph, record, and use my image, likeness, voice, and participation in photos, videos, social media content, promotional materials, advertisements, websites, and marketing materials without compensation or approval.

I understand content may be used for promotional purposes including Instagram, TikTok, websites, league marketing, and future events.

8. Food & Beverage Disclaimer

I acknowledge that beverages, snacks, food products, or sponsor items may be sold, distributed, or provided during league activities by AYSocialSports or third-party vendors.

I understand AYSocialSports is not responsible for food allergies, dietary restrictions, ingredient sensitivities, contamination, or adverse reactions.

Participation in any food or beverage offerings is voluntary and at my own risk.

9. Refund & Weather Policy

Registration fees are non-refundable once the season begins.

AYSocialSports reserves the right to reschedule, postpone, shorten, modify, or cancel activities due to weather, unsafe playing conditions, attendance levels, facility limitations, or operational needs.

No refunds will be provided for missed games, scheduling conflicts, vacations, or voluntary non-attendance.

10. Participant Code of Conduct

AYSocialSports is committed to maintaining a welcoming, respectful, inclusive, and safe environment.

All participants are expected to demonstrate good sportsmanship and respectful conduct.

Participants may not:

• Harass, threaten, intimidate, or discriminate against others

• Engage in dangerous or overly aggressive behavior

• Physically or verbally abuse referees, organizers, or participants

• Participate while intoxicated or under the influence

• Purposely disregard league rules or create unsafe conditions

• Engage in conduct that disrupts the community environment

AYSocialSports reserves the right to remove any participant without refund for behavior deemed unsafe, inappropriate, disruptive, discriminatory, or unsportsmanlike.
 

11. Roster & Participation Rules

All participants must:

• Complete registration

• Sign this waiver

• Be listed on an official team roster

• Follow league guidelines and organizer instructions

AYSocialSports reserves the right to deny participation to any player who has not completed registration requirements.
 

12. California Waiver

If I am a California resident or participating in activities in California, I expressly waive all rights under California Civil Code Section 1542, which states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release…”

I knowingly waive these protections.
 

13. Agreement

I acknowledge that I have carefully read and fully understand this Waiver and Release of Liability.

I understand that by signing this agreement, I am giving up substantial legal rights, including the right to sue.

I voluntarily agree to these terms without coercion or inducement.
